D.Sugar: Japan and South Korea are still in negotiation | Mongolia ...

Interview of D.Sugar who is the Director of Board of Members of ?Erdenes MGL? and ?Erdenes Tavantolgoi? and member of government?s working group on investment tender bid for Tavan Tolgoi?s western Tsankhi deposit.

Q: What stage the Tavan Tolgoi?s tender bid?s process at? When the new investment agreement will be presented to the Parliament?

D.Sugar: Tavan Tolgoi?s deposit consists of two main parts. The coking coal reserve of east and west block of Tavan Tolgoi is comparable. The Parliament approved that ?Erdenes Tavantolgoi? LLC would operate on the eastern block of TT. We are choosing the investors for the western block and the process is ongoing. We have agreed upon few matters and there are obviously more issues to be discussed. I think that this work should be done at the end of this year or by October to be precise.

Q: Companies from South Korea and Japan were excluded from the tender bid. For what reasons were day dropped out?

D.Sugar: I want to talk about few facts before commenting on that. First of all, the investment tender bid is officially not over yet. The government presented a draft to the National Security Council and it was rejected and sent back. Now, let me tell you why it looks like Japan and South Korean companies are dropped out. There are Peabody-USA, consortium of Shenhua-China and Mitsui-Japan and huge consortium of Russian Railways and companies Japanese and South Korean companies. Our organizers sent invitations to the companies that played the leading roles in the consortium. That is why it looks as if they were excluded from the tender bid.

Q: So does it mean that South Korea and Japan are still in the negotiation?

D.Sugar: Let me tell you what I think and what I predict and I think the Prime Minister?s idea is similar to mine. There are no reasons to exclude the Japanese and Korean companies because we need to cooperate in the future. To be honest, they have let us down in the past. Japan and Korea say Mongolia has the reserves and they have the high-tech and together it can be successful project but the expected high-tech did not come. We wanted steel factory and coal producing technologies but they did not include that in the proposal. They want to buy coal from us and said that they are interested in investing in some parts. This has let the working group down and the outcome of the tender bid process could be affected by that. There are no official results for the tender bid yet and there are also enough time to get things right and improve the wrongdoings in the investment agreement.

Q: So where did the Russian-Mongolian consortium come out from?

D.Sugar: There are three consortiums that are officially in negotiation in the tender bid. It is true that the name Mongolia is not included but the Resolution 39 of the SGK states that Mongolian company can be entered. The government should name the company first. It could be ?Erdenes MGL? or it could be any company. The main thing we should understand is that we did not exclude Japanese and South Korean companies. I think the media also played a large role in the misunderstandings.

Q: Which Mongolian Company is interested in the tender bid?

D.Sugar: It could be any company. Mongolian companies could even establish the 4th consortium and take part. First, we should take care of the 3 large consortiums. China expressed its interest by saying that they could buy all the brown and black coals that are unwanted in the global market. We have no problem with selling the coking coal but coal used for thermal power stations will only be used in Mongolia and China.

First, they will buy all the unwanted brown coals. Second, the coking coal will be transported through China and Shenhua is the one of the largest company in the world and they want to be respected for that. So China expressed their interest to have 51% share.

Russia says that they will build majority of the new railways and Russian border ports will be used to transport the coking coal to Japan and South Korea. Russia is large strategic partner of Mongolia and they also want to have 51% share.

Peabody also wants 51% share because they are the largest company in the world in terms of mining and they set th
e standards for technologies and safety in the mining sector. Peabody stated that they have the best connections in the world to sell our coking coal.

If we gather all these, we would have 153%. What we need now is to satisfy the needs of those big three consortiums in real life and also squeeze in the Mongolian company. The Mongolian company will not be there to own big portions but will have to exist for monitoring purposes. Mongolians need to learn foreign techniques and technologies by doing so. Investor consortiums are looking to provide initial payment of USD 1 billion each. The previous draft with 40%, 36% and 24% may came out because of the statement above.

The Japanese side met with me yesterday and they said that they want to be apart from the Russian Railways and have their own proportion of 10%. This is not official result but Japan expressed their interests.

AP Sources: Growth hormone test added to NFL deal (AP)

WASHINGTON ? The wait is over. The NFL officially is back in business, collective bargaining agreement and all.

That 4 1/2-month lockout? A thing of the past in every way.

All those players with new contracts who had to sit out practice for a few days? They hit the field with all of their teammates shortly after word spread that football finally had a completely done deal Thursday.

"Were we going to have the opportunity to step on the field today? Was this thing going to linger?" new Minnesota Vikings quarterback Donovan McNabb said, explaining his thoughts while waiting for the OK to fully participate. "Good thing we got this thing settled. And now here we are."

Players ratified a new, 10-year CBA on Thursday, hours after it was finalized, and two people familiar with the negotiations told The Associated Press the contract allows the NFL to eventually become the first major U.S. professional sports league to use blood testing for human growth hormone.

They spoke on condition of anonymity because no formal announcement had been made about the details of the CBA.

Players would be subject to random testing for HGH, in addition to annual checks ? as is the case for all banned substances in the league's drug-testing program ? only after the union is confident in the way the testing and appeals process will work.

"We have to see if we agree with the test," Jacksonville Jaguars cornerback Rashean Mathis said. "If we agree with the test, then it's legit. If not, they have to come up with another one."

The aim is to have everything worked out in time to start HGH testing by Week 1 of the regular season, but that is not guaranteed.

"Everyone in this game has championed making sure drugs aren't involved in our game. So we are finding our way through this," said Indianapolis Colts center Jeff Saturday, who was one of the players' key negotiators in recent months. "It hasn't been easy, just understanding all the ins and outs of it."

Most of the deal to end the NFL's first work stoppage since 1987 was agreed to last month, but certain elements still needed to be ironed out after the NFL Players Association re-established itself as a union. The union ? which dissolved itself in March, when the old CBA expired, allowing players to sue the league in federal court ? was again formed by last weekend. Final CBA language was in place Thursday afternoon in talks between the sides' lawyers in Washington.

Not every player welcomed the new CBA with open arms.

"We felt like it was getting shoved down our throats," Pittsburgh Steelers offensive tackle Willie Colon said. "Our players reps (weren't) comfortable with it ... We're not going to just file it away the way other teams do."

When the union informed the league that the NFLPA's team reps voted to approve the final agreement, it meant players who signed contracts July 26 or after ? and had been forced by NFL rules to sit out practices for days ? could join teammates in drills Thursday, as the new "league year" officially began.

"We were like little kids in Pop Warner who didn't make weight, just standing around," said McNabb, who restructured his contract when he was traded to Minnesota by the Washington Redskins.

A little after 5 p.m., the NFL's website about the labor dispute was shut down. Later Thursday evening, the federal court in Minnesota that was the venue for the antitrust suit filed by Tom Brady and other players, as well as a TV networks "lockout insurance" case, officially deemed those cases dismissed.

As a final, formal step, NFL Commissioner Roger Goodell and NFLPA executive director DeMaurice Smith will sign the CBA at the front steps of the Pro Football Hall of Fame in Canton, Ohio, on Friday morning. That's where the only game canceled by the lockout was supposed to be played Sunday between the Bears and Rams.

Among the CBA elements that were settled this week: parameters for penalties associated with on-field discipline and new disability program guidelines. Under a new neuro-cognitive disability benefit, for example, players do not have to prove that their mental disability was related to playing football.

For on-field offenses ? which grabbed headlines last season when the league made a point of enforcing existing rules about illegal hits more strictly ? the NFLPA must be consulted before a player is suspended or fined more than $50,000. And players now will be able to argue on appeal that a fine is excessive if it exceeds 25 percent of one week's pay for a first offense or 50 percent of a week's pay for a second offense.

The off-field conduct policy remains largely unchanged and in Goodell's hands.

The most significant new item in Thursday's agreement, though, is the HGH testing, which was the last topic holding things up.

Goodell has been keen to have players tested for HGH, saying in an interview with the AP in August 2010: "It's about the integrity of the game."

"We think it's important to have HGH testing, to make sure we ensure that we can take performance-enhancing substances out of the game," Goodell said then.

Preventing athletes from using HGH is considered a key target in the anti-doping movement. The substance is hard to detect, and athletes are believed to choose HGH for a variety of benefits, whether they be real or only perceived ? including increasing speed and improving vision.

Last year, Major League Baseball implemented random blood testing for HGH in the minors, making it the first U.S. professional sports league to take that aggressive step against doping. Baseball was able to impose that on players with minor league contracts because they are not members of the players' association, which means blood testing is not subject to collective bargaining.

Gary Wadler, who until this year led the World Anti-Doping Agency's committee that considers which substances should be banned in sports, cautioned Thursday that it will be important to find out the specifics that eventually are agreed to by the NFL and players.

"You can get a sound bite out of saying the NFL and NFLPA have adopted a blood-testing policy. You can say, 'That's pretty good,' and forget the rest of the story," Wadler said in a telephone interview. "But the devil's in the details. The rest of the story might be equivalent to having no testing at all."

Researchers at Johns Hopkins found that use over time and not just genetics informs the structure of jaw bones in human populations. The researchers say these findings may be used to predict the diet of an ancient population, even if little evidence exists in the fossil record. It can also make it easier for scientists to pinpoint the genetic relationship between fossils.

Their results were published online June 23 in the American Journal of Physical Anthropology.

"Our research aimed to see how much of the mandible's?or jaw bone's?shape is plastic, a response to environmental influences, such as diet, and how much is genetic. We used archaeological jaw bones from two different regions to answer that question," explains Megan Holmes, graduate student at the Johns Hopkins Center for Functional Anatomy and Evolution, and lead author of the paper. "Before we can make inferences about what the shape of a bone tells us, like what environment the individual lived in, who it's related to or what it ate, we have to understand what creates that shape. The idea that function influences the shape of jaw bones is great for the archeological record in terms of discovering the diet of a population, and it's also really useful for reconstructing the fossil record?finding which fossils are related to which, and how."

The group chose to study the Arikara and Point Hope American Indian populations, since they were genetically isolated from other groups and ate different diets. They investigated bones from the regions dating back to the 1600s and 1700s, times for which the diets are known from other records. The Point Hope population in Alaska ate a "hard" diet that included tough dried meat. They also used their teeth for a variety of nonfood-related tasks, such as stripping leather. The Arikara, from the Dakota area of the United States, ate a softer diet, which consisted of farming supplemented with light hunting.

The researchers precisely measured jaw bones from 63 members of the Point Hope population and 42 individuals from the Arikara population using an X-ray gun as well as calipers, and they used those measurements to extrapolate the proportions of the entire jaw. "The jaw bones were similar in children before they were old enough to start chewing, but different in adulthood, which implies that this divergence is likely a functional result of their diet and the use of their jaw, rather than genetics," says Holmes.

The changes to the jaw bones were explained using a theory drawn from engineering, which directly relates the geometry of a bone to the stresses put on it during use. The team was able to investigate very specific parts of the jaw bones and relate them to specific dietary habits. In the Point Hope population, for example, they found round, wide jaw bones?a result of having to exert more force to chew a harder diet. The Arikara, on the other hand, did not show this expansion, which they attributed to the lighter chewing requirement of a softer diet.

"Genetics creates a blueprint of the bone, but a lot of things influence the bone's construction," says Holmes. "Mechanical pressure from muscle stress and strain from day-to-day activities can remodel the bone's surface and internal structure. Knowing how much the shape of a mandible we find is related to diet and how much genetically connects it to fossils found elsewhere can really help us parse out the family tree."
